   7 This license ("License")  contains rights and
   8 restrictions associated with use of the
   9 accompanying software. Read the License carefully
  10 and select "Agree" at the bottom of this text
  11 window if you wish to install the software.

  13 1. Limited License Grant. By selecting "Agree" at
  14 the bottom of this text window, Sun grants to you
  15 ("Licensee") a non-exclusive, non-transferable
  16 limited license to use the Software without fee
  17 for evaluation of the Software and for
  18 development of Java compatible servlets. Licensee
  19 may make one archival copy of the Software and
  20 may re-distribute complete,  unmodified copies of
  21 the Software to software developers within
  22 Licensee's organization to avoid unnecessary
  23 download time, provided that this License
  24 conspicuously appear with all copies of the
  25 Software. Except for the foregoing and the
  26 distribution rights authorized for the servlet
  27 classes specified in Section 2 below, Licensee
  28 may not re-distribute the Software in whole or in
  29 part, either separately or included with a
  30 product.

  32 2.      License to Distribute Servlet Classes.
  33 Licensee is granted a royalty-free right to
  34 reproduce and distribute the servlet classes
  35 contained in the Software identified therein as
  36 "Sun.Servlet.*," "Javax.Servlet.*" or
  37 "Jsdk.Doc.Apidoc.*" ("Servlet Classes") provided
  38 that Licensee: (i) distrib- utes the Servlet
  39 Classes complete and unmodified only as part of,
  40 and for the sole purpose of run- ning, Licensee's
  41 Java compatible servlets  ("Servlets"); (ii) does
  42 not distribute additional soft- ware intended to
  43 replace any component(s) of the Servlet Classes;
  44 (iii) agrees to incorporate the most current
  45 version of the Software that was available from
  46 Sun no later than 180 days prior to each
  47 production release of the Servlet; (iv) does not
  48 remove or alter any proprietary legends or no-
  49 tices contained in the Servlet Classes; (v)
  50 includes the provisions of Sections 3, 4, 6, 8,
  51 and 9 in Licensee's license agreement for the
  52 Program; and (vi) agrees to indemnify, hold
  53 harmless, and de- fend Sun and its licensors from
  54 and against any claims or lawsuits, including
  55 attorneys' fees, that arise or result from the
  56 use or distribution of the Program.

  58 3. Restrictions. Software is confidential
  59 copyrighted information of Sun and title to all
  60 copies is retained by Sun and/or its licensors.
  61 Licensee shall not modify, decompile,
  62 disassemble, decrypt, extract, or otherwise
  63 reverse engineer Software. Software may not be
  64 leased, assigned, or sublicensed, in whole or in
  65 part. Software is not designed or intended for
  66 use in on-line control of aircraft, air traffic,
  67 aircraft navigation or aircraft communications;
  68 or in the design, construction, operation or
  69 maintenance of any nuclear facility. Licensee
  70 warrants that it will not use or redistribute the
  71 Software for such purposes.

  73 4. Trademarks and Logos. This License does not
  74 authorize Licensee to use any Sun name, trademark
  75 or logo. Licensee acknowledges that Sun owns the
  76 Java trademark and all Java-related trademarks,
  77 logos and icons including the Coffee Cup and Duke
  78 ("Java Marks") and agrees to: (i) to comply with
  79 the Java Trademark Guidelines at
  80 http://java.com/trademarks.html; (ii) not do
  81 anything harmful to or inconsistent with Sun's
  82 rights in the Java Marks; and (iii) assist Sun in
  83 protecting those rights, including assigning to
  84 Sun any rights acquired by Licensee in any Java
  85 Mark.

  87 5. Disclaimer of Warranty. Software is provided
  88 "AS IS," without a warranty of any kind. ALL
  89 EXPRESS OR IMPLIED REPRESENTATIONS AND
  90 WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF
  91 MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE
  92 OR NON-INFRINGEMENT, ARE HEREBY EXCLUDED.

  94 6. Limitation of Liability.   SUN AND ITS
  95 LICENSORS SHALL NOT BE LIABLE FOR ANY DAMAGES
  96 SUFFERED BY LICENSEE OR ANY THIRD PARTY AS A
  97 RESULT OF USING OR DISTRIBUTING SOFTWARE. IN NO
  98 EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR ANY
  99 LOST REVENUE, PROFIT OR DATA, OR FOR DIRECT,
 100 INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR
 101 PUNITIVE DAMAGES, HOWEVER CAUSED AND REGARDLESS
 102 OF THE THEORY OF LIABILITY, ARISING OUT OF THE
 103 USE OF OR INABILITY TO USE SOFTWARE, EVEN IF SUN
 104 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
 105 DAMAGES.

 107 7. Termination. Licensee may terminate this
 108 License at any time by destroying all copies of
 109 Software. This License will terminate immediately
 110 without notice from Sun if Licensee fails to
 111 comply with any provision of this License. Upon
 112 such termination, Licensee must destroy all
 113 copies of Software.

 115 8. Export Regulations. Software, including
 116 technical data, is subject to U.S. export control
 117 laws, including the U.S. Export Administration
 118 Act and its associated regulations, and may be
 119 subject to export or import regulations in other
 120 countries. Licensee agrees to comply strictly
 121 with all such regulations and acknowledges that
 122 it has the responsibility to obtain licenses to
 123 export, re-export, or import Software. Software
 124 may not be downloaded, or otherwise exported or
 125 re-exported (i) into, or to a national or
 126 resident of, Cuba, Iraq, Iran, North Korea,
 127 Libya, Sudan, Syria or any country to which the
 128 U.S. has embargoed goods; or (ii) to anyone on
 129 the U.S. Treasury Department's list of Specially
 130 Designated Nations or the U.S. Commerce
 131 Department's Table of Denial Orders.

 133 9. Restricted Rights. Use, duplication or
 134 disclosure by the United States government is
 135 subject to the restrictions as set forth in the
 136 Rights in Technical Data and Computer Software
 137 Clauses in DFARS 252.227-7013(c) (1) (ii) and FAR
 138 52.227-19(c) (2) as applicable.

 140 10. Governing Law. Any action related to this
 141 License will be governed by California law and
 142 controlling U.S. federal law. No choice of law
 143 rules of any jurisdiction will apply.

 145 11. Severability. If any of the above provisions
 146 are held to be in violation of applicable law,
 147 void, or unenforceable in any jurisdiction, then
 148 such provisions are herewith waived to the extent
 149 necessary for the License to be otherwise
 150 enforceable in such jurisdiction.   However, if
 151 in Sun's opinion deletion of any provisions of
 152 the License by operation of this paragraph
 153 unreasonably compromises the rights or increase
 154 the liabilities of Sun or its licensors, Sun
 155 reserves the right to terminate the License and
 156 refund the fee paid by Licensee, if any, as
 157 Licensee's sole and exclusive remedy.
