   5 SUN MICROSYSTEMS, INC. ("SUN") IS WILLING TO LICENSE THE
   6 SOFTWARE IDENTIFIED BELOW TO YOU ONLY UPON THE CONDITION
   7 THAT YOU ACCEPT ALL OF THE TERMS CONTAINED IN THIS BINARY
   8 CODE LICENSE AGREEMENT AND SUPPLEMENTAL LICENSE TERMS
   9 (COLLECTIVELY "AGREEMENT"). PLEASE READ THE AGREEMENT
  10 CAREFULLY. BY DOWNLOADING OR INSTALLING THIS SOFTWARE, YOU
  11 ACCEPT THE TERMS OF THE AGREEMENT. INDICATE ACCEPTANCE BY
  12 SELECTING THE "ACCEPT" BUTTON AT THE BOTTOM OF THE
  13 AGREEMENT. IF YOU ARE NOT WILLING TO BE BOUND BY ALL THE
  14 TERMS, SELECT THE "DECLINE" BUTTON AT THE BOTTOM OF THE
  15 AGREEMENT AND THE DOWNLOAD OR INSTALL PROCESS WILL NOT
  16 CONTINUE.

  18 1. DEFINITIONS. "Software" means the identified above in
  19 binary form, any other machine readable materials
  20 (including, but not limited to, libraries, source files,
  21 header files, and data files), any updates or error
  22 corrections provided by Sun, and any user manuals,
  23 programming guides and other documentation provided to you
  24 by Sun under this Agreement. "General Purpose Desktop
  25 Computers and Servers" means computers, including desktop,
  26 laptop and tablet computers, or servers, used for general
  27 computing functions under end user control (such as but not
  28 specifically limited to email, general purpose Internet
  29 browsing, and office suite productivity tools).  The use of
  30 Software in systems and solutions that provide dedicated
  31 functionality (other than as mentioned above) or designed
  32 for use in embedded or function-specific software
  33 applications, for example but not limited to: Software
  34 embedded in or bundled with industrial control systems,
  35 wireless mobile telephones, wireless handheld devices,
  36 kiosks, TV/STB, Blu-ray Disc devices, telematics and
  37 network control switching equipment, printers and storage
  38 management systems, and other related systems is excluded
  39 from this definition and not licensed under this
  40 Agreement.  "Programs" means Java technology applets and
  41 applications intended to run on the Java Platform Standard
  42 Edition (Java SE) platform on Java-enabled General Purpose
  43 Desktop Computers and Servers.

  45 2. LICENSE TO USE. Subject to the terms and conditions of
  46 this Agreement, including, but not limited to the Java
  47 Technology Restrictions of the Supplemental License Terms,
  48 Sun grants you a non-exclusive, non-transferable, limited
  49 license without license fees to reproduce and use
  50 internally Software complete and unmodified for the sole
  51 purpose of running Programs. Additional licenses for
  52 developers and/or publishers are granted in the
  53 Supplemental License Terms.

  55 3. RESTRICTIONS. Software is confidential and copyrighted.
  56 Title to Software and all associated intellectual property
  57 rights is retained by Sun and/or its licensors. Unless
  58 enforcement is prohibited by applicable law, you may not
  59 modify, decompile, or reverse engineer Software. You
  60 acknowledge that Licensed Software is not designed or
  61 intended for use in the design, construction, operation or
  62 maintenance of any nuclear facility. Sun Microsystems, Inc.
  63 disclaims any express or implied warranty of fitness for
  64 such uses. No right, title or interest in or to any
  65 trademark, service mark, logo or trade name of Sun or its
  66 licensors is granted under this Agreement. Additional
  67 restrictions for developers and/or publishers licenses are
  68 set forth in the Supplemental License Terms.

  70 4. LIMITED WARRANTY. Sun warrants to you that for a period
  71 of ninety (90) days from the date of purchase, as evidenced
  72 by a copy of the receipt, the media on which Software is
  73 furnished (if any) will be free of defects in materials and
  74 workmanship under normal use. Except for the foregoing,
  75 Software is provided "AS IS". Your exclusive remedy and
  76 Sun's entire liability under this limited warranty will be
  77 at Sun's option to replace Software media or refund the fee
  78 paid for Software. Any implied warranties on the Software
  79 are limited to 90 days. Some states do not allow
  80 limitations on duration of an implied warranty, so the
  81 above may not apply to you. This limited warranty gives you
  82 specific legal rights. You may have others, which vary from
  83 state to state.

  85 5. DISCLAIMER OF WARRANTY. UNLESS SPECIFIED IN THIS
  86 AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS,
  87 REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED
  88 WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
  89 PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE
  90 EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY
  91 INVALID.

  93 6. LIMITATION OF LIABILITY. TO THE EXTENT NOT PROHIBITED BY
  94 LAW, IN NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR
  95 ANY LOST REVENUE, PROFIT OR DATA, OR FOR SPECIAL, INDIRECT,
  96 CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER
  97 CAUSED REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT
  98 OF OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE,
  99 EVEN IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
 100 DAMAGES. In no event will Sun's liability to you, whether
 101 in contract, tort (including negligence), or otherwise,
 102 exceed the amount paid by you for Software under this
 103 Agreement. The foregoing limitations will apply even if the
 104 above stated warranty fails of its essential purpose. Some
 105 states do not allow the exclusion of incidental or
 106 consequential damages, so some of the terms above may not
 107 be applicable to you.

 109 7. TERMINATION. This Agreement is effective until
 110 terminated. You may terminate this Agreement at any time by
 111 destroying all copies of Software. This Agreement will
 112 terminate immediately without notice from Sun if you fail
 113 to comply with any provision of this Agreement. Either
 114 party may terminate this Agreement immediately should any
 115 Software become, or in either party's opinion be likely to
 116 become, the subject of a claim of infringement of any
 117 intellectual property right. Upon Termination, you must
 118 destroy all copies of Software.

 120 8. EXPORT REGULATIONS. All Software and technical data
 121 delivered under this Agreement are subject to US export
 122 control laws and may be subject to export or import
 123 regulations in other countries. You agree to comply
 124 strictly with all such laws and regulations and acknowledge
 125 that you have the responsibility to obtain such licenses to
 126 export, re-export, or import as may be required after
 127 delivery to you.

 129 9. TRADEMARKS AND LOGOS. You acknowledge and agree as
 130 between you and Sun that Sun owns the SUN, SOLARIS, JAVA,
 131 JINI, FORTE, and iPLANET trademarks and all SUN, SOLARIS,
 132 JAVA, JINI, FORTE, and iPLANET-related trademarks, service
 133 marks, logos and other brand designations ("Sun Marks"),
 134 and you agree to comply with the Sun Trademark and Logo
 135 Usage Requirements currently located at
 136 http://www.sun.com/policies/trademarks. Any use you make of
 137 the Sun Marks inures to Sun's benefit.

 139 10. U.S. GOVERNMENT RESTRICTED RIGHTS. If Software is being
 140 acquired by or on behalf of the U.S. Government or by a
 141 U.S. Government prime contractor or subcontractor (at any
 142 tier), then the Government's rights in Software and
 143 accompanying documentation will be only as set forth in
 144 this Agreement; this is in accordance with 48 CFR 227.7201
 145 through 227.7202-4 (for Department of Defense (DOD)
 146 acquisitions) and with 48 CFR 2.101 and 12.212 (for non-DOD
 147 acquisitions).

 149 11. GOVERNING LAW. Any action related to this Agreement
 150 will be governed by California law and controlling U.S.
 151 federal law. No choice of law rules of any jurisdiction
 152 will apply.

 154 12. SEVERABILITY. If any provision of this Agreement is
 155 held to be unenforceable, this Agreement will remain in
 156 effect with the provision omitted, unless omission would
 157 frustrate the intent of the parties, in which case this
 158 Agreement will immediately terminate.

 160 13. INTEGRATION. This Agreement is the entire agreement
 161 between you and Sun relating to its subject matter. It
 162 supersedes all prior or contemporaneous oral or written
 163 communications, proposals, representations and warranties
 164 and prevails over any conflicting or additional terms of
 165 any quote, order, acknowledgment, or other communication
 166 between the parties relating to its subject matter during
 167 the term of this Agreement. No modification of this
 168 Agreement will be binding, unless in writing and signed by
 169 an authorized representative of each party.

 171 SUPPLEMENTAL LICENSE TERMS

 173 These Supplemental License Terms add to or modify the terms
 174 of the Binary Code License Agreement. Capitalized terms not
 175 defined in these Supplemental Terms shall have the same
 176 meanings ascribed to them in the Binary Code License
 177 Agreement . These Supplemental Terms shall supersede any
 178 inconsistent or conflicting terms in the Binary Code
 179 License Agreement, or in any license contained within the
 180 Software.

 182 A. Software Internal Use and Development License Grant.
 183 Subject to the terms and conditions of this Agreement and
 184 restrictions and exceptions set forth in the Software
 185 "README" file incorporated herein by reference, including,
 186 but not limited to the Java Technology Restrictions of
 187 these Supplemental Terms, Sun grants you a non-exclusive,
 188 non-transferable, limited license without fees to reproduce
 189 internally and use internally the Software complete and
 190 unmodified for the purpose of designing, developing, and
 191 testing your Programs.

 193 B. License to Distribute Software. Subject to the terms and
 194 conditions of this Agreement and restrictions and
 195 exceptions set forth in the Software README file,
 196 including, but not limited to the Java Technology
 197 Restrictions of these Supplemental Terms, Sun grants you a
 198 non-exclusive, non-transferable, limited license without
 199 fees to reproduce and distribute the Software, provided
 200 that (i) you distribute the Software complete and
 201 unmodified and only bundled as part of, and for the sole
 202 purpose of running, your Programs, (ii) the Programs add
 203 significant and primary functionality to the Software,
 204 (iii) you do not distribute additional software intended to
 205 replace any component(s) of the Software, (iv) you do not
 206 remove or alter any proprietary legends or notices
 207 contained in the Software, (v) you only distribute the
 208 Software subject to a license agreement that protects Sun's
 209 interests consistent with the terms contained in this
 210 Agreement, and (vi) you agree to defend and indemnify Sun
 211 and its licensors from and

 213 C. License to Distribute Redistributables. Subject to the
 214 terms and conditions of this Agreement and restrictions and
 215 exceptions set forth in the Software README file, including
 216 but not limited to the Java Technology Restrictions of
 217 these Supplemental Terms, Sun grants you a non-exclusive,
 218 non-transferable, limited license without fees to reproduce
 219 and distribute those files specifically identified as
 220 redistributable in the Software "README" file
 221 ("Redistributables") provided that: (i) you distribute the
 222 Redistributables complete and unmodified, and only bundled
 223 as part of Programs, (ii) the Programs add significant and
 224 primary functionality to the Redistributables, (iii) you do
 225 not distribute additional software intended to supersede
 226 any component(s) of the Redistributables (unless otherwise
 227 specified in the applicable README file), (iv) you do not
 228 remove or alter any proprietary legends or notices
 229 contained in or on the Redistributables, (v) you only
 230 distribute the Redistributables pursuant to a license ag

 232 D. Java Technology Restrictions.  You may not create,
 233 modify, or change the behavior of, or authorize your
 234 licensees to create, modify, or change the behavior of,
 235 classes, interfaces, or subpackages that are in any way
 236 identified as "java", "javax", "sun" or similar convention
 237 as specified by Sun in any naming convention designation.

 239 E. Distribution by Publishers. This section pertains to
 240 your distribution of the Software with your printed book or
 241 magazine (as those terms are commonly used in the industry)
 242 relating to Java technology ("Publication"). Subject to and
 243 conditioned upon your compliance with the restrictions and
 244 obligations contained in the Agreement, in addition to the
 245 license granted in Paragraph 1 above, Sun hereby grants to
 246 you a non-exclusive, nontransferable limited right to
 247 reproduce complete and unmodified copies of the Software on
 248 electronic media (the "Media") for the sole purpose of
 249 inclusion and distribution with your Publication(s),
 250 subject to the following terms: (i) You may not distribute
 251 the Software on a stand-alone basis; it must be distributed
 252 with your Publication(s); (ii) You are responsible for
 253 downloading the Software from the applicable Sun web site;
 254 (iii) You must refer to the Software as JavaTM SE
 255 Development Kit 6; (iv) The Software must be reproduced in
 256 its entirety and without any modification what

 258 F. Source Code. Software may contain source code that,
 259 unless expressly licensed for other purposes, is provided
 260 solely for reference purposes pursuant to the terms of this
 261 Agreement. Source code may not be redistributed unless
 262 expressly provided for in this Agreement.

 264 G. Third Party Code. Additional copyright notices and
 265 license terms applicable to portions of the Software are
 266 set forth in the THIRDPARTYLICENSEREADME.txt file. In
 267 addition to any terms and conditions of any third party
 268 opensource/freeware license identified in the
 269 THIRDPARTYLICENSEREADME.txt file, the disclaimer of
 270 warranty and limitation of liability provisions in
 271 paragraphs 5 and 6 of the  Binary Code License Agreement
 272 shall apply to all Software in this distribution.

 274 H. Termination for Infringement. Either party may terminate
 275 this Agreement immediately should any Software become, or
 276 in either party's opinion be likely to become, the subject
 277 of a claim of infringement of any intellectual property
 278 right.

 280 I. Installation and Auto-Update.  The Software's
 281 installation and auto-update processes transmit a limited
 282 amount of data to Sun (or its service provider) about those
 283 specific processes to help Sun understand and optimize
 284 them.  Sun does not associate the data with personally
 285 identifiable information.  You can find more information
 286 about the data Sun collects at http://java.com/data/.
